By accessing or using The Night Desk at lofistudio.io ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.

2. Description of Service

The Night Desk is a web-based productivity workspace that provides tools including a Pomodoro timer, task management, ambient sounds, lofi music streams, focus statistics, and wellness features. The Service is available in a free tier and a paid Pro tier.

3. User Accounts

You may use the Service without an account. Creating an account enables cloud sync, focus history, and Pro features. You are responsible for:

• — Keeping your credentials secure
• — All activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these terms.

4. Pro Subscription

Pro subscriptions are billed monthly or annually through our payment processor, Polar. By subscribing you agree that:

• — Subscriptions renew automatically until cancelled
• — You can cancel at any time; access continues until the end of the billing period
• — We may change pricing with 30 days notice

5. Acceptable Use

You agree not to:

• — Attempt to reverse engineer, scrape, or disrupt the Service
• — Share, resell, or redistribute Pro access
• — Impersonate other users or attempt to access their accounts

6. Third-Party Content

The Service embeds YouTube streams and may link to third-party content. We are not responsible for the availability, accuracy, or legality of any third-party content. YouTube streams are subject to YouTube's own Terms of Service.

7. Intellectual Property

All original content, design, and code of The Night Desk is owned by its developers. You retain ownership of any data you create (tasks, notes, session data). You grant us a limited license to store and process your data solely to provide the Service.

8. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability, data durability, or fitness for a particular purpose. Use of the Service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data or interruption of service.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will make reasonable efforts to notify users of significant changes.
